These Terms of Service ("Terms") govern your use of Fishrift and all services, features, and products made available through fishrift.com ("Platform"). By creating an account or using the Platform in any way, you agree to these Terms. If you do not agree, do not use the Platform.


1. About Fishrift

Fishrift is a creator tools and monetisation platform. We provide streamers and content creators with tools to manage livestream overlays, alerts, activity feeds, a chatbot, loyalty systems, and public creator profiles — and to monetise their audience through donations, memberships, and digital product sales.

Fishrift is currently in Alpha. This means features are actively being built and may change, break, or be removed. We will communicate significant changes via email and via Sonar (our in-app notification system) at least 30 days before any material change takes effect.

Fishrift is a platform facilitator, not a seller. When a fan purchases a membership or digital product from a creator on Fishrift, the legal transaction is between the fan and the creator. Fishrift provides the infrastructure and payment facilitation but is not a party to that transaction, does not take ownership of any goods or services sold, and is not the merchant of record.

Payment processing is handled by Stripe, Inc. and its affiliates ("Stripe") under Stripe's own terms of service. Fishrift uses Stripe Connect to enable creators to receive payments directly.


2. Definitions

  • "Fishrift", "we", "us", "our" — Fishrift, operator of the Platform.
  • "Creator" — any user who publishes a profile, accepts donations, creates membership tiers, or sells products on the Platform.
  • "Fan" / "Member" — any user who donates to, subscribes to, or purchases from a Creator.
  • "User" — any person using the Platform, whether Creator, Fan, or visitor.
  • "Content" — any text, images, video, audio, files, or other material published on the Platform.
  • "Membership" — a recurring subscription a Fan purchases to access a Creator's exclusive content and benefits.
  • "Digital Product" — a one-time purchasable digital file or download sold by a Creator through the Fishrift Store.
  • "Platform Fee" — the percentage Fishrift deducts from Creator transactions as a service charge.
  • "Stripe Connect" — the payment infrastructure through which Creators receive funds directly from Fans.
  • "Fishcoins" — a virtual loyalty currency system available on the Platform with no monetary value.
  • "Grandfathering Guarantee" — Fishrift's commitment to existing paid subscribers, described in Section 6.

3. Eligibility

You must be at least 18 years old to create an account, accept payments, or make purchases on the Platform. By using the Platform, you represent that you meet this requirement.

Users must provide accurate, complete, and current information during registration and keep it updated. Accounts created with false information may be suspended or terminated.


4. Accounts

4.1 Registration

To access most Platform features you must register an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

4.2 Account security

Notify us immediately at legal@fishrift.com if you become aware of any unauthorised use of your account. Fishrift is not liable for losses resulting from unauthorised use of your account where you have not notified us promptly.

4.3 One account per person

You may not create multiple accounts to circumvent suspensions, bans, or Platform Fee obligations.

4.4 Team access

Creators may invite team members (Engineer, Pilot, Commander, Navigator, Mission Controller) with varying levels of access. Creators are responsible for all actions taken by their team members through Fishrift. Invite links expire in 10 minutes and are single-use. Revoke access immediately if a link is compromised.


5. The Facilitator Model — Creator as Seller

5.1 Creator is the seller

When a Creator accepts donations, sells Digital Products, or offers Memberships through Fishrift, the Creator is the legal seller of those goods and services. The contract of sale is formed directly between the Creator and the Fan. Fishrift is not a party to that contract.

5.2 Fishrift's role

Fishrift provides:

  • The infrastructure to display Creator profiles and content
  • Payment facilitation via Stripe Connect
  • Access control and delivery of digital content
  • Tools for managing memberships, tiers, overlays, alerts, and bots

Fishrift does not:

  • Take ownership of any funds beyond its Platform Fee
  • Take responsibility for the quality, legality, or delivery of Creator content
  • Act as a merchant of record for Creator transactions
  • Issue tax documentation (VAT invoices etc.) on behalf of Creators for their own sales

5.3 Creator responsibility

Creators are solely responsible for:

  • The accuracy and quality of their content and products
  • Compliance with all applicable laws including tax obligations
  • Responding to Fan support requests, refund requests, and disputes
  • Ensuring their content does not infringe third-party intellectual property rights
  • Compliance with applicable consumer protection laws regarding their own sales

5.4 Tax responsibility

Fishrift does not collect, remit, or manage taxes on behalf of Creators. Creators are responsible for determining, collecting, and remitting all applicable taxes (including VAT and income tax) on their sales. Fishrift may provide tools to assist with tax calculation but the legal obligation remains with the Creator.


6. Fishrift Platform Subscriptions and the Grandfathering Guarantee

Fishrift offers a free tier (Creator) and paid tiers (Goldfish, Tuna, Shark) that unlock additional platform features.

6.1 The Grandfathering Guarantee

When you subscribe to a paid Fishrift tier, Fishrift takes a snapshot of exactly what that tier includes at that moment — storage, features, and price. This snapshot is your personal agreement with Fishrift. Fishrift will never:

  • Increase the price you pay while your subscription remains active
  • Remove features from your tier while your subscription remains active
  • Reduce your storage allocation while your subscription remains active

If Fishrift improves a tier (adds features, increases storage), existing subscribers may opt into the improvements. Declining an improvement does not affect your existing snapshot.

This guarantee survives any change in Fishrift's ownership or business model.

6.2 Cancellation

You may cancel your subscription at any time from Account → Subscription. No dark patterns. One click to cancel.

6.3 EU Right of Withdrawal and Immediate Access

Under EU consumer law (Directive 2011/83/EU, implemented in Dutch law as Boek 6 BW), you ordinarily have a 14-day right of withdrawal from the date of your first payment.

By subscribing to a Fishrift paid plan, you explicitly request immediate access to the paid features and confirm — via the checkbox presented at checkout — that you waive your right of withdrawal in accordance with Article 16(m) of Directive 2011/83/EU. This waiver is logged with a timestamp, your IP address, and the exact text you agreed to at the moment of subscription.

You may cancel your subscription at any time from Account → Subscription. Cancellation takes effect at the end of the current billing period. No refunds are issued for remaining days of a paid period, except where required by applicable mandatory law that cannot be excluded by this waiver.

6.4 Price changes for new subscribers

If Fishrift changes the price of a tier for new subscribers, existing subscribers receive at least 30 days' notice before any change affects their billing. Per the Grandfathering Guarantee, existing subscribers never pay the new price unless they cancel and resubscribe.


7. Platform Fees on Creator Transactions

The Platform Fee is deducted automatically via Stripe Connect before funds are paid out to the Creator.

7.2 Stripe processing fees

Stripe charges its own payment processing fees separately from Fishrift's Platform Fee. These fees are set by Stripe and are not controlled by Fishrift. Current rates are available at stripe.com/pricing.

7.3 Fee changes

Fishrift may change its Platform Fee with at least 30 days' written notice. Continued use after the notice period constitutes acceptance. Creators who do not accept the new fee may terminate their account before the new fee takes effect.


8. Stripe Connect and Creator Payouts

8.1 Stripe Connect requirement

To accept Memberships or sell Digital Products, Creators must connect a Stripe account via Stripe Connect Express. Creators agree to Stripe's Connected Account Agreement in addition to these Terms.

8.2 Funds never held by Fishrift

Under the Stripe Connect structure, funds paid by Fans are never in Fishrift's possession or control. All funds flow directly between Fan, Stripe, and Creator. Fishrift receives only its Platform Fee portion via Stripe's fee splitting mechanism.

8.3 Payout timing

Funds are paid out to Creators by Stripe according to Stripe's standard payout schedule. Fishrift does not control payout timing.

8.4 Stripe identity verification

Stripe requires Creators to complete identity verification (KYC) as part of Stripe Connect onboarding. Fishrift has no access to and no control over Stripe's verification process.


9. Memberships

9.1 Creator membership tiers

Creators may create membership tiers with a name, price, and description of benefits. Creators set their own prices and define their own benefits. Fishrift does not guarantee or warrant any benefits described by Creators.

9.2 Fan subscription

By subscribing to a Creator's membership tier, a Fan enters into a recurring subscription agreement directly with the Creator, facilitated by Stripe. The Fan authorises recurring charges at the interval set by the Creator.

9.3 Cancellation by Fan

Fans may cancel their membership subscription at any time. Cancellation takes effect at the end of the current billing period. Fishrift does not issue refunds for partial billing periods unless required by applicable consumer law.

9.4 Creator obligations

Creators who offer memberships must:

  • Deliver the benefits described in their tier(s) in good faith
  • Respond to Fan support enquiries in a reasonable time
  • Not make material changes to membership benefits without notice to existing members
  • Handle refund requests fairly and in accordance with applicable consumer law

10. Digital Store and Product Sales

10.1 Creator as seller

Creators who sell Digital Products through Fishrift are acting as the legal seller. The product sale contract is between the Creator and the Fan. Fishrift is not a party to that contract.

10.2 EU right of withdrawal for digital products

Under EU consumer law, Fans have a 14-day right of withdrawal on digital product purchases. This right is waived when the Fan explicitly consents to immediate delivery and acknowledges loss of withdrawal rights, per Article 16(m) of Directive 2011/83/EU. Fishrift facilitates this consent capture at checkout. Creators are responsible for honouring withdrawal rights for Fans who did not provide this consent.

10.3 Delivery

Fishrift delivers purchased Digital Products via a download link sent to the Fan on purchase. Fishrift stores the file on behalf of the Creator and facilitates delivery. The Creator is responsible for ensuring the file is correct and accessible.


11. External Donation Sources

Fishrift supports a generic external donation webhook system. This allows Creators' own websites or payment processors to trigger Fishrift alerts when a donation is confirmed.

In this system:

  • Fishrift never handles or processes the payment
  • Money flows directly between donor and the Creator's payment processor
  • Fishrift only receives a signed notification that a payment occurred
  • Donors interact with the Creator's own site, not with Fishrift directly
  • Fishrift charges 0% on externally processed donations

12. Content Policy

12.1 Permitted content

Creators may publish content related to their streaming, creative work, and community — subject to the restrictions in Section 12.2.

12.2 Prohibited content

The following content is strictly prohibited on the Platform:

  • Content that is illegal under Dutch law or EU law
  • Child sexual abuse material or any content sexualising minors
  • Content that incites violence, hatred, or discrimination based on protected characteristics
  • Fraudulent, deceptive, or misleading content
  • Content that infringes third-party intellectual property rights
  • Malware, spyware, or malicious code
  • Content that violates the terms of service of connected platforms (Twitch, YouTube, Kick, etc.)

12.3 Enforcement

Fishrift may remove content that violates this policy without prior notice. Repeat violations may result in account suspension or termination.

12.4 Copyright / DMCA

If you believe content on the Platform infringes your copyright, please send a written notice to legal@fishrift.com including:

  • Identification of the copyrighted work claimed to be infringed
  • Identification of the allegedly infringing material and its location
  • Your contact information
  • A statement of good faith belief that the use is not authorised
  • A statement of accuracy and authority to act on the rights holder's behalf

13. Fishcoins and Loyalty System

Fishcoins (or any name a Creator assigns to their loyalty currency) are a virtual loyalty currency with no monetary value. They:

  • Cannot be exchanged for real money under any circumstances
  • Cannot be transferred between Creator channels
  • Cannot be purchased directly with money
  • Are earned through channel activity as configured by the Creator
  • May be reset or lost if a channel is deleted or the loyalty system is reset by the Creator

Fishrift is not responsible for Fishcoins lost due to technical issues, Creator decisions, or account termination.


14. Privacy and Data

Fishrift's collection and processing of personal data is governed by the Fishrift Privacy Policy at fishrift.com/privacy, which forms part of these Terms. By using the Platform, you agree to the Privacy Policy.

Fishrift processes personal data in accordance with the EU General Data Protection Regulation (GDPR) (Regulation (EU) 2016/679).


15. Prohibited Conduct

Users may not:

  • Use the Platform for any illegal purpose
  • Attempt to gain unauthorised access to any part of the Platform or another user's account
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Use automated tools (bots, scrapers) to access or extract Platform data without prior written consent from Fishrift
  • Artificially inflate donation counts, membership numbers, viewer counts, loyalty balances, or any other metrics
  • Use the Platform to transmit spam, unsolicited communications, or malicious code
  • Impersonate another person or entity
  • Circumvent the Platform Fee through off-platform payment arrangements with Fans introduced through Fishrift
  • Use Fishrift's bot or automation features to violate the terms of connected platforms

16. Suspension and Termination

16.1 By Fishrift

Fishrift may suspend or terminate any account, with or without notice, for violation of these Terms, fraudulent activity, chargeback abuse, or any conduct harmful to the Platform, other users, or third parties.

16.2 By the Creator

Creators may close their account at any time via account settings. Upon closure, active Fan memberships are cancelled at the end of the current billing period. Creators remain responsible for fulfilling outstanding Digital Product access.

16.3 Effect of termination

Upon termination, the Creator's profile and content will be removed from public view. Personal data is deleted per the Privacy Policy. Platform Fees already earned by Fishrift are non-refundable.


17. Disclaimers and Limitation of Liability

17.1 Platform provided as-is

The Platform is provided "as is" and "as available." Fishrift makes no warranties, express or implied, regarding uninterrupted availability or error-free operation.

17.2 Limitation of liability

To the maximum extent permitted by applicable law, Fishrift's total liability to any User for any claim is limited to the greater of the total amount paid to Fishrift in the 12 months preceding the claim or €100. Fishrift is not liable for indirect, incidental, special, or consequential damages.

17.3 Consumer rights preserved

Nothing in this section limits rights that cannot be excluded or limited under applicable Dutch consumer law or EU consumer protection law.


18. Indemnification

Creators agree to indemnify and hold harmless Fishrift, its officers, employees, and agents from any claims, damages, or expenses arising from Creator content or products, breach of these Terms, or Creator's failure to comply with applicable tax or consumer protection obligations.


19. Governing Law and Dispute Resolution

19.1 Governing law

These Terms are governed by the laws of the Netherlands.

19.2 Jurisdiction

Disputes shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands, subject to any mandatory consumer protection provisions under applicable law.

19.3 EU consumers

EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

19.4 Informal resolution

Before initiating formal proceedings, both parties will attempt to resolve disputes informally by contacting legal@fishrift.com. Fishrift will respond within 15 business days.


20. Changes to These Terms

Fishrift may update these Terms at any time. For material changes, Fishrift will notify Users via email or Sonar at least 30 days before the change takes effect. Continued use after the notice period constitutes acceptance. Users who do not accept updated Terms may terminate their account before the effective date.


21. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Fishrift regarding the Platform.
  • Severability: If any provision is found invalid or unenforceable, the remaining provisions continue in full force.
  • No waiver: Fishrift's failure to enforce any provision does not constitute a waiver of future enforcement.
  • Assignment: Fishrift may assign its rights in connection with a merger, acquisition, or sale of assets with 30 days' notice to users.
  • Language: These Terms are written in English. The English version controls in the event of any conflict with a translation.
